“Okaz” has learned that the Ministry of Human Resources and Social Development’s Qiwa platform allows owners of individual establishments with crossed-out commercial records, whose establishments are sponsored by professional workers, and who wish to benefit from its services, the ability to open multiple files on the platform, and that the role of the new file is limited to only one service: “Transfer of employees from establishments with canceled records to existing establishments.”
The platform said the new files against independent contractors are classified as “penalty” and that the penalty is “suspension of enhanced services, except for employee transfer services,” which allow users to transfer employees from facilities where records have been deleted to existing facilities. He said that after closing the files related to the canceled commercial register, the penalty for new files will be lifted and users will be able to benefit from all the services of the platform.
The Ministry of Commerce has previously clarified that shops must amend the conditions of the Supplementary Commercial Register within a period not exceeding five years from the date of entry into force of the scheme, with a deadline of April 3, 2030. After the expiry of this period, the subsidiary commercial register will be deleted, but the trade name associated with the subsidiary register will only be retained for 60 days. During this period, the seller has the right to extend the reservation, use or disposal of the name after registering it in the commercial register.
According to the mechanism for correction of the auxiliary commercial register, three main mechanisms are identified: “transfer of the auxiliary commercial register by establishing a new company, transfer of the auxiliary commercial register to another person not registered in the commercial register, and deletion of the auxiliary commercial register.”
The Ministry of Commerce said that licenses, authorizations and activities related to the Supplementary Commercial Register will also be handled according to three cases: If the Supplementary Commercial Register is amended by the establishment of a new company, the licenses, authorizations and activities will be linked to the new company, but if the Supplementary Commercial Register is transferred to another person, the licenses, permits and activities will be linked to the successor without prejudice to the rights of creditors. If the subsidiary commercial register is removed, licenses, authorizations and activities will be linked to the main commercial register.
